Ok seems like I gotta say this.....

A while back I was sharing an idea I had with a friend, or at least I thought he was. The idea was about a knife design with a cool clip and a cool name. Funny thing, I just saw the idea of mine in a magazine.

So I am making the following post to make CERTAIN that the names I may have also used in that conversation are known to all that they are mine.

FUBAR To be used on a military style knife that will look really cool and it is a play on the Ka-Bar name.
Black Angel A knife of my design
CYA Pronounced "SeeYA" but also accurate for the acronym "Cover Your Ass".
WTF Yes the acronym but it is what you will say anyway when you see this knife.
G-Force A sheath system that David Bloch at Outdoor edge came up with but was actually the name of a knife. I will use it on sheaths and name the knife something else as I plan to use the sheath for several knives and G-Force was a cool name for the sheath
Cirrus & Stratus David Bloch gave me these names and I will be using them.

Sorry but I will not elaborate on what happened further than stated above for legal reasons but I will venture to say that it will all come out.

I don't think the Fighting Utility Combat Knife has been used yet. Feel free to use that name Mike.

Oh yeah, I THINK we did also use the word "HOLY", so may I suggest you take this up with the BIG GUY to CYA. I would hate to see you visited by both BLACK and WHITE ANGELS!!!

Oh I am not sueing the guy. I just can't say what I really think of him :)

I am using FUBAR because it is now a general military term that many know of. But we may change that too.
 
Cirrus and Stratus are currently produced Dodge automobiles and G-force is a name (trademarked, I believe)of a watch.
 
As regarding intellectual property...

I've often been told that, to protect your intellectual property rights, you should jot them down, mail them to a friend or to yourself, and then leave them, unopened and postmarked, in a safety deposit box or something similar.

I wonder, would discussing something here serve the same purpose? To demonstrate that an idea originated with you? Or would it serve the exact OPPOSITE purpose, and waive any such rights, since this is a Public Forum, and you could be construed as thus offering the idea, "For Public Consumption?"

You all need to walk that proverbial mile in Mike's moccasins or combat boots and you might not find this so damned funny then. Remember that he is a small businessman and that a cool name goes a long way toward selling a product these days. It is a major asset and Mike had it stolen from him, perhaps through a misunderstanding, perhaps not, but what he has done would seem to be an attempt to preclude another such occurance. Good luck with it, Mike.
 
Since FUBAR is being used, then a couple of smaller knives should be SNAFU and then TARFU. FUBAR should be the largest, in keeping with this naming convention... ;)
 
In the event that this thread becomes serious, Mike should know that to preserve these, or any other names, for knives, he should "Trademark" them and not rely on a forum post.
 
I call my Spyderco Endura, Steve.
My Buck 709 is named Ethel.
My SAK Spartan is named Vaclav.
My Buck 526 is named Fritz.
And my carbon steel Old Timer goes by Rusty. ;)
 
Cirrus and Stratus cna be used in our industry as we do not sell cars and there is no concern for consumer confusion.

By using the names here I have efectively tradmarked them and there is no need at this time to register them.

Is registration of my mark required?

No. You can establish rights in a mark based on legitimate use of the mark. However, owning a federal trademark registration on the Principal Register provides several advantages, e.g.,
constructive notice to the public of the registrant's claim of ownership of the mark;
a legal presumption of the registrant's ownership of the mark and the registrant's exclusive right to use the mark nationwide on or in connection with the goods and/or services listed in the registration;
the ability to bring an action concerning the mark in federal court;
the use of the U.S registration as a basis to obtain registration in foreign countries; and
the ability to file the U.S. registration with the U.S. Customs Service to prevent importation of infringing foreign goods.


When can I use the trademark symbols TM, SM and ®?

Any time you claim rights in a mark, you may use the "TM" (trademark) or "SM" (service mark) designation to alert the public to your claim, regardless of whether you have filed an application with the USPTO. However, you may use the federal registration symbol "®" only after the USPTO actually registers a mark, and not while an application is pending. Also, you may use the registration symbol with the mark only on or in connection with the goods and/or services listed in the federal trademark registration.


You guys can have some fun, it is OK I am not mad at yall poking fun. Even though this is a serious matter my point was made and may public claim to use the above marks is now made as well.

That is an old wives tail and you are in no way protecting yourself. It is often done but you have NO legal rights when you do it. All it will do is establish that you may have thought of an idea but you did nothing to protect yourself.
 
I actually think that they are good names, and it probably isnt a terrible place to post them since a lot of industry types tend to hang out here, and the nasty part about information on computers is that it is really hard to do away with (remember Monica?).
