in your "knockoffs" article a couple of years ago, wasn't there a Taiwanese version of the Ka-bar called the FUBAR? Are those the ones you will be selling, or is this a different model?

Just because you say the names are yours they are?
I just don't get it.

Who is to say that some knife company did not do the same thing with a list of a couple million differant names say 5 years ago, 1 year ago, one day befor you did, etc....

So you go ahead and name a knife you are selling only to find out that someone else said befor you "I say *killer* is my knife name so you can't use it because I called if first" :rolleyes:

Is there not more to it then that?
 
I would buy an F.U.C.K. just for the laughs I'll get when I tell people about my new purchase.

And anytime I need to open envelopes, I could mutter like a maniac:

"I'm gonna F.U.C.K. you up, envelope." :)

Simple, Whoe cares if they have a list of names, I do too, we call it a dictionary but the point is I am showing intent to use them and this is legally binding.

Microtech had to rename a knife 3 times because tehy kept using names already in use in our very own industry. I even offered to help them do a name search BEFORE they anounced it. You can do a search on the auto forum for that one as it was very funny and both names (Patriot and Guardian) belonged to one company, Gerber (Fiskars).

I even offered the name Cheetah which is now on my butterfly knives.

Oh ya I forgot about Akula, and I plan on using it too :)

I still think there is an enormous hole in your logic Mike. While BFC is a "Public Forum" it does not rise to the legal definition established for the posting of claims in public to establish a "trademark"

My undertsanding is that you are still required to post this is major public sources or places for a specified number of Business days. Sources of "Public" IMO are places like the NY Daily News, some major knife Magazine and of course the National Enquirer.

Seriously, I wish you the best of luck.

BFC's readership is on par or better than all the magazines in our industry combined not to mention it is searchable.

The post will remain here for years, not days.

To establish a trademark or rights to it you would have to advertise in a publication that caters to that market. Putting an ad in a newspaper would be less effective than here although the Enquirer sounds interesting and they are right down the road from here in Lantana :D

BFC is also established as a place where manufacturers go not only to announce new products and names but to ask for members to give them ideas for names. I think a judge would see this and would give BFC the nod over any trade publication. Also has anyone EVER seen ANY manufacturer do they above in any trade publication other than here?

Whith the above understanding I can think of no better public venue than BFC, Can you?

My only concern is, someone might later claim that BFC is "too close to Mike Turber" to serve as the evidence. Ridiculous, of course, but someone might try to make the claim--or might claim that the posting dates were electronically changed to give Mike priority.
One time I had a document notarized; it didn't cost very much. What do the lawyers think?
 
All very cute, and I don't know either if the courts would allow BFC to be the sort of public venue that would establish your claim. When I started a business, I had to advertise the name in a regional newspaper...

But this all reminds me of my boss who years ago asked me to come up with an acronym to describe a computer process I had developed. This was before this particular kind of process became common place. I came up with all kinds of acronyms, but the one that actually worked best and described what took place was Remote Activated Procedure Execution! The boss didn't think it was funny!
